The NSW context

Operations create the facts. Records support them.

Revenue NSW states that eligible land must be used dominantly for primary production and the resulting animals, produce or outputs must be held or produced for sale. Additional commercial tests apply to land that is not rural land.

An arrangement with another operator may support an exemption where the underlying activity is genuine. The owner remains responsible for providing detailed evidence of that use and any competing uses.

Can primary production reduce NSW land tax?

Eligible land used dominantly for genuine primary production may qualify for an exemption. The answer depends on the property's zoning, actual use, scale, commercial character, competing uses and Revenue NSW's assessment. Independent tax or legal advice is essential.

Will this disrupt the way I use my property?

The operating plan is designed for minimal disruption and agreed before work begins. Access, residences, recreation, rentals, livestock movements and property presentation are considered as part of the assessment.

What primary production activities do you manage?

Cattle breeding and grazing are the preferred focus where the land supports them. Depending on the property, beekeeping, livestock management, pasture improvement, plant propagation or another commercially credible enterprise may be considered.

Do records alone make a property eligible?

No. The primary production activity must be genuine. Documentation supports the operating facts; it does not replace them or guarantee an exemption.
